Design patent is the object of patent right and the object protected by patent law. It refers to the design that should be granted patent right according to law. It is completely different from the invention or utility model, that is, the design is not a technical solution. Article 2 of the patent law of the people's Republic of China stipulates that "design" refers to a new design of a product's shape, pattern or their combination, as well as the combination of color, shape and pattern, which is aesthetic and suitable for industrial application. It can be seen that the design patent shall meet the following requirements: it refers to the design of shape, pattern, color or their combination; it must be the design of the appearance of the product; it must be full of aesthetic feeling; it must be suitable for industrial application.
